1. Introduction and Acceptance of Terms

Welcome to Couples Closet. These Terms and Conditions govern your use of our website at couples-closet.co.za and any purchases you make through it. By accessing our website, browsing our products or placing an order, you agree to be bound by these Terms and Conditions.

Please read these terms carefully before placing an order. If you do not agree with any part of these terms, please do not use our website or place an order.

3. Age Restriction

Couples Closet sells adult wellness products intended exclusively for persons aged 18 years and older. By using this website and placing an order, you warrant and confirm that:

  • You are at least 18 years of age;
  • You are legally permitted to purchase adult products in your jurisdiction; and
  • You are not purchasing products on behalf of a person under the age of 18.

We reserve the right to cancel any order and refuse service where there is reasonable suspicion that the purchaser is under the age of 18, without incurring any liability to you.

This requirement is in accordance with the Films and Publications Act (Act 65 of 1996, as amended).

4. Products and Descriptions

We make every effort to ensure that the product descriptions, images and specifications displayed on our website are accurate and complete. However, we do not warrant that all product information is entirely free from error. If you receive a product that differs materially from its description, please refer to our Refund and Returns Policy.

All product images are for illustrative purposes. Minor variations in colour may occur due to screen display settings.

5. Pricing

  • All prices on our website are displayed in South African Rand (ZAR).
  • Prices include VAT where applicable.
  • Delivery charges are calculated separately and are clearly displayed before you confirm your order.
  • No additional or hidden fees will be added at checkout beyond the product price and stated delivery charge.
  • We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you place your order.
  • Where a promotional or sale price is displayed, the original price shown is the genuine price at which the product was previously offered for sale.

6. How to Place an Order

You may place an order as a guest or as a registered customer. Guest checkout is always available — you are never required to create an account to make a purchase.

The order process is as follows:

  1. Select your products and add them to your cart.
  2. Proceed to checkout and enter your delivery and contact details.
  3. Review your order summary, including products, quantities, prices and delivery charges.
  4. You will have the opportunity to review and correct any errors before submitting your order.
  5. Submit your order and complete payment.
  6. You will receive an order acknowledgement email once payment has been received and confirmed.

7. When a Contract Is Formed

A binding contract between you and Couples Closet PTY LTD is formed when we despatch your order. Your order acknowledgement email confirms receipt of your order but does not constitute acceptance of the contract.

We reserve the right to cancel an order if any product in your order is out of stock or unavailable. In such cases, you will be notified promptly and a full refund will be issued for the affected items.

8. Payment

  • Full payment is required at the time of checkout. We do not offer buy-now-pay-later, layby or instalment arrangements.
  • Payment is processed securely through Peach Payments. Couples Closet does not receive, handle or store your payment card details at any point.
  • Accepted payment methods are displayed at checkout and may include credit card, debit card and instant EFT.
  • Your order will only be processed and despatched once payment has been received in full and confirmed.

9. Delivery

We currently deliver to addresses within South Africa only.

  • Estimated delivery time frames are provided at checkout and in your order confirmation email. These are estimates and not guaranteed delivery dates.
  • You are responsible for providing a correct and complete delivery address. We are not liable for delays or failed deliveries caused by incorrect address information.

  • Risk of loss passes to you upon delivery of the goods to the delivery address specified in your order.

10. Returns and Refunds

Due to the intimate nature of our products, we operate a no-return policy for change-of-mind purchases once a product has been unsealed, for hygiene and safety reasons.

This does not affect your statutory rights. If you receive a product that is defective, damaged or materially different from what you ordered, you are entitled to a replacement or full refund in accordance with Section 56 of the Consumer Protection Act.

11. Limitation of Liability

To the fullest extent permitted by South African law:

  • Couples Closet PTY LTD shall not be liable for any indirect, incidental, special or consequential damages arising from your use of our website or the purchase of products.
  • Our total liability to you in respect of any claim shall not exceed the purchase price of the product(s) giving rise to the claim.
  • We are not liable for any delay or failure in performance resulting from circumstances beyond our reasonable control, including but not limited to courier delays, natural disasters, power outages or disruptions to telecommunications.

Nothing in these terms limits or excludes any rights you have under the Consumer Protection Act that cannot lawfully be limited or excluded.

12. Intellectual Property

All content on this website — including text, images, logos, product descriptions, design elements and software — is the property of Couples Closet PTY LTD or its licensors and is protected by South African and international intellectual property laws. You may not copy, reproduce, distribute or use any content from this website without our prior written permission.

Product names and brand names referenced on this website are the trademarks of their respective owners and are used solely for product identification purposes.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of our website shall be subject to the jurisdiction of the South African courts.

14. Dispute Resolution

If you have a complaint or dispute regarding an order, a product or our service, we encourage you to contact us first so that we can attempt to resolve the matter directly:

We encourage you to review these terms periodically. Your continued use of the website following any changes constitutes your acceptance of the revised terms.

Changes to these terms will not apply retrospectively to orders already placed and confirmed.
